If the E-Mail address provided by Net Vision Internet Services is
not required, or shall not be used as the client's principal E-Mail address, the client
shall notify Net Vision Internet Services of their principal E-Mail address within 24
hours of commencing to use the services provided by Net Vision Internet Services.
Either the E-mail address supplied by Net Vision Internet Services, or the client's
principal E-Mail address, shall be checked at least twice weekly, at equal intervals, to
allow for the collection all invoices, receipts, advisements of outages and notices sent
by Net Vision Internet Services to maintain normal quality of service. Accounts may be
deleted if not accessed within any three month period, as will the associated web space,
mail box and E-Mail address and the E-Mail messages contained within. E-Mail messages may
also be deleted if not collected within any three month period.
Net Vision Internet Services retains the right to alter plan and usage charges from time
to time and shall give affected clients 30 days notice by letter, facsimile or electronic
mail of any such alteration.
Casual Rate Plans incur a minimum charge of $11.00 per Month or $16.50 per Month with
associated Web Site space activated.
Plan fees are payable in advance on a monthly basis, as well as all additional usage fees,
if any, incurred during the previous month, are invoiced by electronic mail, or debited at
the beginning of each month, being the first day of each month whenever possible. All
accounts are on a continuing basis and accounts are automatically charged for the
commencing month's services, unless written notification is given no less than 5 days
prior to the end of the month or billing period. If the client chooses to make payments
via credit card, it shall be debited automatically at the start of each month for the
commencing month's payment plus any additional usage fees incurred during the previous
month, unless notice is given at least 5 days prior to the end of the month or billing
period. If notice is given, resulting in the request for cancellation of a client's
account, only the additional usage fees for the previous month, if any, will be debited.
Should a credit card number expire or should Net Vision Internet Services otherwise be
unable to debit valid charges to this credit card number, Net Vision Internet Services may
immediately and without notice withdraw the client's access to all services provided by
Net Vision Internet Services. Cash, cheque and direct deposit clients are given a grace
period of 5 days after the first of each month for payment for that month's services
supplied by Net Vision Internet Services, plus any additional usage fees incurred during
the previous month. If full payment is not received within this grace period, Net Vision
Internet Services may immediately and without notice withdraw the client's access to all
services provided by Net Vision Internet Services.
New clients and clients consistantly making late payments, may be required, at the
discretion of Net Vision Internet Services, to pay for all additional usage fees in
advance, in pre-purchased blocks, once the client has reached their account limit of
M/Bytes and / or hours. If payment for additional usage is not immediately forthcoming, or
within a time period so determined by Net Vision Internet Services at the time, Net Vision
Internet Services may immediately and without notice, withdraw the client's access to all
services provided by Net Vision Internet Services regardless of how many days may still
remain within that calender month or billing period.
Where a client defaults on payment and requests reconnection, a $22.00 reconnection fee
will be charged.
Net Vision Internet Services may use any means at their disposal to recover monies due.
Clients give Net Vision Internet Services the right to debit credit card facilities at any
time should payments become owing. The client is responsible for any and all collection,
legal and processing charges incurred by Net Vision Internet Services in collection of
monies owing.
Net Vision Internet Services will perform regular backups of all hosted Web Sites, but the
ultimate responsibility lies with the client to perform their own backups of their Web
Sites. Net Vision Internet Services will not be responsible for the loss of a client's Web
Site due to hardware failure, if the client does not possess a backup copy of their Web
Site since the last backup performed by Net Vision Internet Services. Likewise, whilst all
security precortions available to Net Vision Internet Services are constantly administered
to protect client's Servers and equipment that is located and housed on Net Vision
Internet Services' property, Net Vision Internet Services accepts no responsibility for
theft or damage to client's Servers and property located and housed on Net Vision Internet
Services' property. On Site Server Location and equipment housing is placed on Net Vision
Internet Services' property solely at the client's risk and responsibility for insuring
same equipment lies solely with the client.
The client agrees to provide a telephone line, modem,
computer and software as is necessary to access the service. The client is responsible for
all telephone charges incurred and indemnifies Net Vision Internet Services against all
such charges.
Where a client contacts Net Vision Internet Services for assistance and the fault is
proven to be with the client's computer, equipment or telephone service, an applicable
service fee may be charged.
Maintainance will be performance twice weekly, usually on a Monday and Friday mornings at
approximately 5.30 AM. This maintainance will be in the form of Server restarts and the
times may vary, anywhere from 4.30 AM to 6.00 AM. These restarts are performed to maintain
the continuing high standard of performance and reliability.
Support hours are from 8.00 AM to 8.00 PM, Monday to Friday and from 8.00 AM to 12.00 Noon
Saturday. Calls may not be answered on Sunday or outside the above hours, but will be
returned during the commencement of the following business hours, if a message is left.
For calls that are answered outside of the above hours and the fault is proven to be with
the client's computer, equipment or telephone service, an applicable service fee will be
charged.
The client is responsible for the selection and use of security features, non disclosure
of personal log-in information and backup of any information.
The client will not use the services provided by Net Vision Internet Services so as to
interfere with or disrupt network users, services or equipment. Disruptions include, but
are not limited to distribution of unsolicited advertising; propagation of computer worms
and viruses, using the network to make an unauthorized entry to any other machine
accessible via the services provided. Net Vision Internet Services reserves the right to
withdraw it's services without notice if the client misuses or abuses the services
provided by Net Vision Internet Services. Net Vision Internet Services determines what
constitutes misuse or abuse of it's services. |
